Under FAA regulations, the owner of an aircraft is presumed to be its operator – responsible for legal compliance, safe operation, and regulatory accountability – unless a properly structured dry lease transfers that responsibility to someone else.
Most dry lease arrangements that circulate among Part 91 owners do not meet that standard. The FAA looks at the reality of the operational relationship, not just the paperwork. When the pilot is also coordinating the trip, handling logistics, and managing the schedule, the FAA may determine that the owner never actually transferred operational control – making the arrangement an illegal charter.
Enforcement of illegal charters is an active FAA priority, particularly in Florida.
